1. Scope

These terms and conditions apply to all rental agreements for the holiday apartments of the Alpen-Apartments Schanzlbichl, Haidachweg 14a, 6263 Fügen, Austria, between the landlord Leitner Sisters GesbR (hereinafter "the landlord") and the guest (hereinafter "the guest"). Deviating agreements apply only if confirmed in writing by the landlord.

2. Booking and conclusion of contract

Bookings can be made by email, by telephone or via the booking platform used. The contract is concluded upon the booking confirmation issued by the landlord or by the booking platform. The booking is binding for both parties.

3. Prices and payment

All prices are quoted in Euro including statutory VAT.  The booking is confirmed upon receipt of the agreed payment. 50% of the total booking price is payable at the time of booking. The remaining 50% is due 14 days before arrival. For bookings made less than 14 days before arrival, the full booking price is payable at the time of booking.  If the outstanding amount is not received by the due date, we reserve the right to cancel the booking. The booking is binding for both parties unless free cancellation has been expressly agreed.

4. Cancellation of contract

1. Form and compliance with deadlines

The guest may withdraw from the accommodation contract at any time by a declaration in text form (email to info@schanzlbichl.at). The time at which the withdrawal declaration reaches us is decisive for compliance with the deadlines. Deadlines are calculated in calendar days; the day of arrival is not counted.

2. Cancellation fee

If the guest cancels more than 30 days before arrival: no cancellation fee applies. Payments already made will be refunded, less any payment or processing fees of third parties actually incurred and not refundable.

30 to 15 days before arrival: The cancellation fee is 50% of the agreed total price.

14 days or less before arrival, as well as in the event of non-arrival (no-show): The cancellation fee is 100% of the agreed total price.

3. Basis of calculation

The "total price" means the agreed price for the booked accommodation for the entire stay (including booked catering and other booked services), but excluding the local tourist tax, which is only incurred for nights actually used.

4. Substitute guest and counter-evidence

The guest may name a substitute guest at any time, provided that this person books the accommodation under the agreed conditions; in this case the cancellation fee does not apply. The guest remains free to prove that we suffered no or a significantly lower loss.

5. Statutory rights

Mandatory statutory rights of the guest remain unaffected. As a rule, there is no statutory right of withdrawal for distance contracts in the case of accommodation agreements for a specific period.

5. Arrival and departure

The apartment is available from 4:00 pm on the day of arrival and must be vacated by 10:00 am on the day of departure. Earlier arrival or later departure is possible only by prior arrangement.

6. The premises and house rules

• Maximum occupancy: 4 persons per apartment
• Pets: not allowed
• Smoking: outside the apartment only / on the balcony
• The apartment must be treated with care; any damage must be reported immediately.

7. Guest liability

The guest is liable for any damage to the apartment and its furnishings caused by the guest or accompanying persons and shall indemnify the landlord accordingly.

8. Landlord liability

The landlord is liable for damage in accordance with the statutory provisions; liability is excluded for property damage caused by slight negligence and for interruptions of electricity, water or internet outside our area of responsibility, to the extent permitted by law.

10. Final provisions

Austrian law applies to this agreement. The place of jurisdiction is the District Court Zell/Ziller. Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
